These Terms of Service ("Terms") govern your use of Nutrition Verified ("we", "us", "our") and any website, content, or service we operate, including nutritionverified.com and nutritionverified.info. By accessing or using Nutrition Verified, you agree to these Terms. If you don't agree, please stop using the service.
1. About Nutrition Verified
Nutrition Verified is an independent food information verification platform based in Queensland, Australia. We review and verify claims that food producers make about their products against published standards.
Nutrition Verified is not:
- A government regulator or certification body.
- A food safety auditor or food regulator.
- A medical, dietary, nutritional, or health advice service.
- A retailer, distributor, or seller of food products.
Nutrition Verified verification confirms that the information a producer declares about their product (origin, ingredients, raising practices, nutritional values, certifications) is accurate, consistent and not misleading at the time of review, based on the information they provide. It is not a guarantee of product quality, food safety, fitness for purpose, or ongoing accuracy.
2. Who Can Use This Service
You can browse Nutrition Verified content if you are at least 16 years old. If you want to apply to become a verified partner, you must be operating a legitimate food production, distribution, or retail business and have the authority to provide the information requested on behalf of that business.
3. How Verification Works
Nutrition Verified operates under our NV 1.0 standard. Verification involves:
1. The producer submitting product information, supporting evidence, and on-pack claims.
2. Nutrition Verified reviewing that information for accuracy, consistency, and whether it is misleading.
3. Where verified, publication of the verified information on our website.
Verified producers pay a subscription fee for the maintenance, hosting, and ongoing review of their verified information. Verification status is current as of the date of review and may be revoked or amended if information becomes inaccurate, the producer changes their practices, or evidence emerges that the original verification was incorrect.
Verification reviews are based on what the producer declares and supporting evidence they provide. Nutrition Verified does not perform on-site farm audits, laboratory testing, or independent supply chain inspections unless explicitly stated.
4. Use of Our Content
"Nutrition Verified" is a registered trade mark in Australia, registered in Class 35 covering consumer product information services relating to food and drink, online retail of foodstuffs, advertising and marketing, and business management and administration. The NV mark, the NV 1.0 standard, the "Verified by Nutrition Verified" claim, our written content, design system, and verified product pages are owned by us or used under licence, and are protected under the Copyright Act 1968 (Cth) and against misleading or deceptive imitation under the Australian Consumer Law and the common law tort of passing off.
You may:
- View, share, and link to our pages for non-commercial purposes.
- Quote short extracts for journalism, education, or commentary, with attribution.
You may not:
- Copy, redistribute, or republish substantial portions of our content commercially without written permission.
- Use the NV mark, NV 1.0 standard, or "Verified by Nutrition Verified" claims to suggest verification you have not actually received.
- Scrape, harvest, or mass-download our verified producer data.
- Use our content to train AI/ML models without our written consent.
5. User Submissions and Reviews
If you submit reviews, feedback, photographs, or other content to us or about a verified partner, you confirm that:
- The content is your own and does not infringe anyone else's rights.
- The content is accurate and not misleading.
- You grant us a non-exclusive, royalty-free, worldwide licence to use, display, and republish the content in connection with Nutrition Verified.
We may remove or refuse to publish submissions at our discretion, especially where they are defamatory, false, abusive, or breach these Terms.
6. Partner Obligations
If you are a verified partner, you agree to:
- Provide accurate, complete, and current information during verification.
- Notify us promptly if any material aspect of your operation, product, or claims changes.
- Display the NV mark and verification information only in ways consistent with our brand guidelines.
- Pay your subscription fees on time.
- Cease use of the NV mark and any "verified" claims if your verification is revoked or your subscription ends.
7. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law or other consumer guarantees that cannot lawfully be excluded. To the maximum extent permitted by law, our liability for any breach of a non-excludable guarantee is limited to (at our option) supplying the service again or paying the cost of supplying the service again.
8. Limitation of Liability
Subject to clause 7, to the maximum extent permitted by law:
- Nutrition Verified is provided "as is" and "as available", without warranties of any kind beyond those required by law.
- We are not liable for any indirect, consequential, incidental, or punitive loss arising from your use of, or inability to use, Nutrition Verified.
- Our total aggregate liability to any user or partner in any 12-month period is capped at the amount actually paid by that user or partner to Nutrition Verified during that period (or AUD $100, whichever is greater).
- We are not liable for the products of any verified partner, including their safety, quality, fitness for purpose, or compliance with the partner's own claims. Any dispute about a product is between you and the partner.
9. Health, Dietary and Medical Information
Nutritional values published on Nutrition Verified are sourced from FSANZ AFCD (Food Standards Australia New Zealand, Australian Food Composition Database) or supplied by the producer and are typical averages, not absolute guarantees. They are not dietary, medical, or health advice. Consult a qualified health practitioner for any decision relating to your diet or health.
10. Termination
We may suspend or terminate access to Nutrition Verified or any partner subscription at any time if you breach these Terms, provide false information, or act in a way that brings the platform into disrepute. We will refund any unused portion of a paid subscription if we terminate the partnership without cause.
11. Changes to These Terms
We may update these Terms from time to time. The current version is always on our website with the "Last updated" date. If we make a material change, we will give partners reasonable notice via email. Continued use of Nutrition Verified after changes are posted constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising out of or in connection with these Terms.
